At Your Leisure 24 Hour Health & Fitness

TERMS AND CONDITIONS OF MEMBERSHIP

As a member of “At Your Leisure 24 Hour Health & Fitness” you may use our facilities 24 hours a day, 7 days a week. There are no limits on how often you can attend by using your personal security access tag at each visit.

1        AGREEMENT OPTIONS:

12 & 18 MONTH DIRECT DEBIT

For both 12 & 18 month direct debits, you are committed to either a 12 or 18 month Membership (hereinafter called your “Agreement”) being of 12 or 18 equal payments. Payments are made on a weekly or fortnightly basis via direct debit from your nominated bank account or debit/ credit card.  To cancel your Agreement you must do so within the ‘cooling off period’ (7 days).  At the conclusion of your minimum term of either 12 or 18 full months, your Agreement will automatically roll over to an ongoing Agreement.  Cancelling your Agreement must be done in line with Clause 16 of these Terms and Conditions.  All direct debit’s attract a small processing fee, imposed by our 3rd party direct debit processing company.  A security bond (equal to your first month) is payable when you sign your Agreement. This will keep you membership one month in advance. Upon providing one months’ notice to cancel your Agreement (if your minimum term has been met) this Bond will be used as your last months’ payment. If, during the term of your membership, you fall into arrears by more than 4 payments (if paying weekly) or 2 payments (if paying fortnightly), this payment will not be used when cancelling and normal cancellation terms will apply. Existing members will be exempt from this payment unless they wish to transfer to another type/ term or change their membership when our yearly sales are on.

 MONTHLY DIRECT DEBIT

For a monthly direct debit Agreement, you are under no contractual obligation for a specified term, but you must remain a financial member for a minimum of three months.  Payments are made on a weekly or fortnightly basis via direct debit from your nominated bank account or debit/ credit card.  Cancelling your Agreement must be done in line with Clause 16 of these Terms and Conditions.  All direct debit’s attract a small processing fee, imposed by our 3rd party direct debit processing company.  A security bond (equal to your first month) is payable when you sign your Agreement.  This will keep you membership one month in advance..  Upon providing one months’ notice to cancel your Agreement (if your minimum term has been met) this Bond will be used as your last months’ payment. If, during the term of your membership, you fall into arrears by more than 4 payments (if paying weekly) or 2 payments (if paying fortnightly), this payment will not be used when cancelling and normal cancellation terms will apply. Existing members will be exempt from this payment unless they wish to transfer to another type/ term or change their membership when our yearly sales are on.

 STUDENT/ SENIOR DIRECT DEBIT

Upon production of a valid Seniors Card, a University or TAFE Identification Card, you can apply for discounted 12 month Agreement.  Payments are made on a weekly or fortnightly basis via direct debit from your nominated bank account or debit/ credit card.  At the conclusion of your minimum term of 12 full months, your Agreement will automatically roll over to an ongoing Agreement.  Cancelling your Agreement must be done in line with Clause 16 of these Terms and Conditions. All direct debit’s attract a small processing fee, imposed by our 3rd party direct debit processing company.  A security bond (equal to your first month) is payable when you sign your Agreement.  This will keep you membership one month in advance..  Upon providing one months’ notice to cancel your Agreement (if your minimum term has been met) this Bond will be used as your last months’ payment.  If, during the term of your membership, you fall into arrears by more than 4 payments (if paying weekly) or 2 payments (if paying fortnightly), this payment will not be used when cancelling and normal cancellation terms will apply. U/18’s DIRECT DEBIT

There is no contractual Agreement for a specified term, but you must remain a financial member for a minimum of one month.  Payments are made on a weekly or fortnightly basis via direct debit from your nominated bank account or debit/ credit card.  This is an ongoing membership and cancelling your Agreement must be done in line with Clause 16 of these Terms and Conditions.  Members who turn 18 during the course of their U/18 membership will be advised by SMS that their membership will change to a Senior Direct Debit Agreement for a term of 12 months.  Members will be given the opportunity to cancel their Agreement if they do not wish to transfer to a Senior Student Agreement.  All direct debit’s attract a small processing fee, imposed by our 3rd party direct debit processing company.  A security bond (equal to your first month) is payable when you sign your Agreement. This will keep you membership one month in advance..  Upon providing one months’ notice to cancel your Agreement (if your minimum term has been met) this Bond will be used as your last months’ payment.  If, during the term of your membership, you fall into arrears by more than 4 payments (if paying weekly) or 2 payments (if paying fortnightly), this payment will not be used when cancelling and normal cancellation terms will apply. Existing members will be exempt from this payment unless they wish to transfer to another type/ term or change their membership when our yearly sales are on.

A Parent or Guardian is required to sign the Membership Agreement on behalf of the student member, acknowledging they are responsible for all payments and arrears that are payable whilst the membership is valid.

2        WHAT’S INCLUDED?

As a financial member of ‘At Your Leisure 24 Hour Health & Fitness’ you may access all equipment and facilities located within the gym area. These include the cardio equipment, pin and plate loaded machines and free weight areas.

3        SECURITY ACCESS TAG:

You will receive a security access tag when you join.  Payment for the security access tag is to be made when joining the gym.  If you lose your tag, you must inform us as soon as possible and purchase a replacement.  The cost of the security access tag is not refundable once paid and the amount is clearly stated on your Agreement.

4        AGE LIMITS:

All members must be at least 14 years old. We recommend any members under the age of 16 to only use the gym within our staffed hours (11am – 6pm, Monday – Friday).  Outside of these hours, we recommend the attendance of a supervising adult.  Only under special circumstances and in consultation with their parent/ guardian will we allow a minor under 14 years of age to become a member. 

5        WHEN DOES IT START?

You are officially a member when you have signed your Agreement, paid your initial direct debit and security access fee and we (“At Your Leisure 24 Hour Health & Fitness”) have accepted it. You are then given 24/7 access to start your health and fitness journey!

6        WHAT IF I CHANGE MY MIND?

“At Your Leisure 24 Hour Health & Fitness” offers a 7-day cooling off period. Once we have accepted your Agreement and you become a member you have 7 days to cancel in person. Should you choose to discontinue your Agreement, you must present in person with your membership form and security access tag in order to receive a refund of your initial payment (excluding the security access tag payment).  Your security access tag fee is not refundable.

7        CAN MY FEES BE INCREASED?

We reserve the right to increase your fees after your minimum Agreement Term has ended.  We will make all reasonable efforts to notify you at least 2 weeks before any changes are made to your fees.  Any changes to bank and direct debit fees will be notified to all members by email at least 2 weeks prior to any change

8       YOUR HEALTH & WELL BEING:

When signing our Membership Agreement you have acknowledged and agreed that each time you choose to use “At Your Leisure 24Hr Health & Fitness”, you are confirming to us that you are in good physical condition to exercise and that you do not know of any medical or other reasons why you should not be using our facilities on that day.  If you believe that there is any risk to your health and safety from participating in any activities, you must notify us in writing, with full details. You must also notify us if your medical conditions change after joining. All direct debit’s attract a small processing fee, imposed by our 3rd party direct debit processing company.

We may refuse your membership application, until:

–   Your Doctor agrees in writing to your Club exercise program, or

–   If you have an exercise program certified by medical staff

You will not be permitted to use our facilities if:

–   You are suffering from an infection, or

–   Have a contagious illness, or

–   A physical ailment, such as an open cut or sore, or

–   If your condition proposes a risk to any Members

Members are expected to respect all the equipment and wipe down the machines once finished.  If members are found to be abusing the equipment or leaving weights or equipment lying around which may cause an Occupational Health & Safety trip hazard, that member will be suspended for 1 week for the first instance, 2 weeks for the second instance, one month for the third instance.  If it is an ongoing issue, the member will have his/ her membership cancelled.

9        FEES:

Your direct debit fees will be taken from your nominated bank account or credit/ debit card. If you like to stay in front, you are welcome to pay as far in advance as you wish by making your payments at the gym. You are required to update your direct debit details (if they change) when your advanced payments run out. All direct debits attract fees and these proportioned in line with the direct debit amount and vary according to what type of account the membership fees are being debited from.  These are added to each direct debit payment on a weekly or fortnightly basis and are not refundable.

10      DIRECT DEBITING:

You recognise that Direct Debit payments are managed and debited on behalf of “At Your Leisure 24 Hour Health & Fitness” by a third party billing agent (EzyPay). You also recognise that the third party billing agent Service Agreement forms part of this overall agreement and all points are fully understood.  EzyPay will debit your agreed membership amount from your nominated bank account or debit/ credit card on the agreed weekly or fortnightly basis.  If your nominated day is on a public holiday, we will debit your account on the next business day. Please note that debits may take up to 5 days to come out of your nominated account.  You are responsible for making sure that there are sufficient funds in your account and can honour all debits. If you are transferring or closing your account or make any changes to your account such as card numbers and expiry date, you must provide at least 48 hours’ notice to us.  Failure to advise of any changes may result in a default fee being added to your direct debit amount by EzyPay.  You further acknowledge that:

a) EzyPay is entitled to store your personal information (whether received from the Customer, the club or otherwise on its systems, and use it for the purposes of administering this Agreement, providing its products and services, or offering alternative products and services;

b) You have a right of access to, and correction of your information under the Privacy Act 1993; and c) EzyPay (or the club) may contact the Customer for any purpose related to the provision of its products and services;

d) EzyPay may notify any debt collection or credit reporting agency upon default by you in regard to any obligation to pay under this Direct Debit Request;

e) You will agree to immediately pay the full outstanding balance of the remainder of the payments due, including any current arrears, should a default occur prior to your Direct Debit request terminating;

f) You may be liable for any costs associated with the recovery of your overdue account, this may include, but is not limited to the following; legal fees, interest and mercantile agency collection cost as noted under Clause 17 of these Terms and Conditions.

11      LATE PAYMENTS:

If you do not pay your fees in full on the due date, your access will be immediately suspended until your payments are up to date. You will also be charged a late payment fee of $8.50. We will debit this from your account and/or debit/ credit card and you authorize us to do so. If you (the member) have nominated a credit card from which membership fees are debited, you give permission for “At Your Leisure 24Hr Health & Fitness” to manually deduct any outstanding payments (including any late payment fees) from this card in the event that you become unfinancial due to outstanding fees.

12      TERM FREEZE:

You have the right to freeze your Agreement at any time with a maximum freeze period of 3 months. This time will be added on to your initial contract term. You will be charged a fee of $10.00 per month for the period covered by the freeze. Before agreeing to freezing your Agreement, all outstanding fees must be paid.  If you have a genuine medical reason which deems you unfit for exercise we will freeze your membership on proof of a medical certificate with no cost to you.

13      SECURITY ACCESS TAG:

You must pay for a security access tag upon joining “At Your Leisure 24 Hour Health & Fitness”.  If you lose or damage your access tag and require a new one, we will charge you a tag fee of $70.00 (for adult and senior student memberships) or $45.00 (for U/18 memberships).  Your security access tag is for YOU and YOU ONLY. Swiping your access tag is MANDATORY for entry into “At Your Leisure 24 Hour Health & Fitness”.  Failing to swipe your tag to gain access to “At Your Leisure 24 Hour Health & Fitness” at any time will result in your name and details not being registered on our security database and therefore, “At Your Leisure 24 Hour Health & Fitness” will not be liable for any loss, damage or injury sustained during this time. Lending of your tag is STRICTLY prohibited and if you are observed either using another member’s tag, allowing non-members into “At Your Leisure 24 Hour Health & Fitness” or using your tag in a manner deemed inappropriate by “At Your Leisure 24 Hour Health & Fitness”, you will be FINED $250.00. If you are caught re-offending, your membership will be cancelled without a refund. If for any reason you request access to “At Your Leisure 24 Hour Health & Fitness” outside of staffed hours (without your tag), a fee of $350.00 will be charged to your account. 

14      CHANGING YOUR DETAILS:

You are responsible to keep us informed when any of your details change. 

15      SUGGESTIONS AND COMPLAINTS:

We appreciate and welcome feedback from our members as this allows us to resolve any concerns as quickly as possible. If you have any feedback or suggestions for the gym or a complaint please contact us either by phone (49501289), in person, by email (info@atyourleisure.com.au) or send a message via our Facebook page.  You can also speak to a staff member about any suggestions or concerns you may have.  We value your feedback and will aim to get back to you within 48 hours (where possible).

16     CANCELLATIONS:

If you are not contractually obligated to “At Your Leisure 24 Hour Health & Fitness”, you may cancel your Agreement by providing one months’ written notice and pay an exit fee equal to one month’s payment. If there are any outstanding payments due at time of cancellation, these must be paid, together with the one months’ exit fee.  Members can make their final payment/s by either:

  • Calling our office on 4950 1289 and making a manual credit card payment over the phone

  • Attending “At Your Leisure 24 Hour Health & Fitness”, completing a cancellation form and pay via EFTPos or Cash

You are only permitted to terminate your Agreement within the minimum contracted term if;

–              You become GENUINELY sick or incapacitated. You must provide a valid medical certificate stating that you cannot exercise for the remainder of your term and why. Your exit fee will be $100.00.

–              You become bankrupt. You must provide supporting documents of this and will not be charged an exit fee.

–              If you relocate to an area more than 30km away from “At Your Leisure 24 Hour Health & Fitness”, you must show us a letter from your real agent or employer to confirm your new location. You will be charged an exit fee of $100.00.

If you wish to cancel FOR ANY OTHER REASON other than those stated above and you are still contractually obligated with “At Your Leisure 24 Hour Health & Fitness”, you agree to pay out the remainder of your Agreement Term and complete a Cancellation Form. 

17      MEMBERSHIP DEFAULT:

 In the event that you default on your obligation to pay 3 consecutive membership fees, your account will be suspended and referred to our debt collection agency and/or law firm for collection.  You (as the member) shall be liable for the recovery costs incurred and if the agency charges commission on a contingency basis, you shall be liable to pay as a liquidated debt, the commission payable by the Supplier to the Agency, fixed at the rate charged by the Agency from time to time as if the Agency has achieved one hundred per cent recovery and the following formula shall apply:

                            ( 100 – Commission % charged by the agency (including GST)     )   x 100

In the event where the agency is Prushka Fast Debt Recovery, the applicable commission rate for the amount unpaid is as detailed on www.prushka.com.au.

In the event where the supplier or the supplier’s agency refers the overdue account to a lawyer, the member shall also pay, as a liquidated debt, the charges reasonably made or claimed by the lawyer on the indemnity basis.

18      TRANSFERS:

You are permitted to transfer your Agreement to another person within the minimum term, provided that the transferee completes a new Application form.  A transfer fee is equivalent to the cost of a new member start-up fee and is payable by the transferee. 

If you wish to transfer from a direct debit membership to a Corporate Membership (ie Caretrac, Fitness Passport, Lake Macquarie Council, Port Stephens Council), you are required to provide one months’ notice to change/ transfer to this type of membership.

19      CAN THE TERMS OF MY AGREEMENT BE CHANGED?

Changes to these Terms and Conditions are discretionary and may be changed and updated without notice. Current Terms and Conditions will be available on our website or can be obtained upon request from reception.

20      WHAT HAPPENS IF I BREAK THE RULES?

We can refuse entry to anyone. If you act unreasonably or breach these Terms and Conditions, we may warn you that you are at risk of having your Agreement cancelled. If you continue to break the rules or behave in the same way we may revoke your privileges under these Terms and Conditions and cancel your Agreement without refund.

21      ETIQUETTE:

All members are to use a towel whilst working out. All machinery must be cleaned and wiped down after use, using cleaning products provided. Swearing and inappropriate language will not be tolerated.  We will immediately terminate your Agreement if we find you harassing or threatening anyone, damaging the equipment, using illegal or performance enhancing drugs or providing instruction to other members where you are not authorised to do so.

22      DAMAGE:

If we find you are responsible for any damage or vandalism, you will be held responsible and will be required to pay for any damages and/or cleaning as a result.  The Gym is under constant 24 hour video surveillance.

23      CLOTHING:

All members and guests of “At Your Leisure 24 Hour Health & Fitness” are required to wear suitable clothing and enclosed sports shoes at all times. Clothing that displays offensive images or inappropriate advertising is not allowed.

24      GUESTS:

Guests are permitted for a fee as outlined in the Casual Visit/ Guest Pass Application Form. Members’ guests must be over the age of 14, enter and leave the Gym with the member and complete aforesaid form on each visit.

ANY MEMBER WHO GIVES UNAUTHORIZED ACCESS TO THE GYM TO A NON-MEMBER WILL AUTOMATICALLY BE CHARGED A $100 FEE FOR EACH GUEST THEY BRING TO THE GYM.

If a member continues to bring unauthorized guests into the Gym they will find their Agreement cancelled without warning or refund.

25      RESTROOMS AND SHOWER FACILITIES:

Please use the restroom and shower facilities in an appropriate manner. Please do not leave your personal belongings in the restrooms or shower facilities when you have finished. Be considerate of others and our environment when using the showers.

26      SAFETY AND SECURITY:

“At Your Leisure 24 Hour Health & Fitness” and the Maryland Shopping Centre are under constant 24 hour surveillance. In the event of an emergency, “At Your Leisure 24 Hour Health & Fitness” is fitted with two duress buttons and also has two duress necklaces that can be worn by members. Misuse of these buttons will result in fines and can also result in loss of membership. Individuals with health problems should never exercise alone.

27      RESPONSIBILITIES:

Your responsibilities, including payment of fees, do not depend on how often you use the Gym.  You must tell us about anything that affects your membership and any changes to your contact or bank details.

28      PRIVACY POLICY:

At Your Leisure takes your privacy seriously. We do not pass your information onto any other business. If you do not wish to receive email, SMS, or mail correspondence from us regarding your membership, special offer, promotions or your health then please send us an email or letter confirming that you wish to unsubscribe for such methods of communication.

You acknowledge and agree that we will have access to personal information about you, such as your health and payment details.  We will only use, disclose or deal with your information in line with our privacy policy.

  • Statement of Commitment

“At Your Leisure 24 Hour Health & Fitness” is committed to protecting your privacy and any personal information we collect.  “At Your Leisure 24 Hour Health & Fitness” complies with the Privacy Act 1988 (Cth).  This policy explains how we may collect, use, disclose and otherwise handle personal and sensitive information.

“At Your Leisure 24 Hour Health & Fitness” is committed to safeguarding personal privacy.  It recognizes that individuals have a right to control how their personal information is collected and used.  Providing personal information is an act of trust and it is taken seriously. 

Unless given consent to do otherwise, “At Your Leisure 24 Hour Health & Fitness” will only collect and use personal information as set out below.

For the purpose of this Privacy Policy, personal information may mean some or all of the following:  a member’s name, contact details, date of birth, emergency contact details, bank account and/or credit card details, student identification details, driver’s license number, employment details, payment history and any other information deemed personal and sensitive.

  • Collecting Personal Information

“At Your Leisure 24 Hour Health & Fitness” will not collect or monitor any personal information about an individual without their consent.  The only personal information collected is what is provided voluntarily.

We collect personal information primarily to enable us to provide members with our services.  “At Your Leisure 24 Hour Health & Fitness” may also use the information for any other purpose permitted under the Privacy Act 1988 (Cth).

When a membership or product is purchased, personal information will be requested in order to provide the requested service or product or provide updated information.  You are not obligated to provide personal information however failure to do so may result in “At Your Leisure 24 Hour Health & Fitness” being unable to provide services or products to you.

Personal information is collected directly upon completion and submission of an application form and given to “At Your Leisure 24 Hour Health & Fitness”.

  • Collecting Sensitive Information

For the purposes of this Privacy Policy, sensitive information means the information a member has disclosed to us about their physical or mental health and well-being.  Sensitive information will only ever be used for providing services to members.  Such information will not be used or disclosed for any other purposes without consent, except in exceptional cases when disclosure may be required by law or is necessary to protect the rights or property of “At Your Leisure 24 Hour Health & Fitness” or any member of the public, or to lessen a serious threat to a person’s health or safety.  For the purposes of this Privacy Policy, sensitive information is a subset of personal information.

  • Using and disclosing your personal information. Personal information will be used for the following primary purposes:

  • To fulfill obligations under the Agreement and/or any other contract between him/ her and “At Your Leisure 24 Hour Health & Fitness”;

  • To render services under the Agreement;

  • To provide information about products, services and/or specific offers to members;

  • To obtain opinions or comments about products and/or services from members;

  • To record statistical data for marketing analysis from members

 

29      PRIVACY DISCLOSURE AND CONSENT:

By signing your Agreement, as a financial member, you agree that “At Your Leisure 24 Hour Health & Fitness” may:

  • Use, disclose or exchange with other credit providers and entities, information about your Credit Arrangements in order to assess credit worthiness and collect overdue accounts and;

  • Disclose the contents of any credit report on the member to our Solicitors and/or mercantile agents

“At Your Leisure 24 Hour Health & Fitness” complies with the privacy principles imposed by law in relation to the collection and disclosure of information regarding individuals.

30      STORAGE AND SECURITY OF PERSONAL AND/OR SENSITIVE INFORMATION:

“At Your Leisure 24 Hour Health & Fitness” takes all reasonable steps to keep secure personal information recorded and to keep this information accurate and up to date.  The personal information is stored in a secure area, which are protected.  “At Your Leisure 24 Hour Health & Fitness” employees are obliged to respect the confidentiality of any personal and/or sensitive information held by “At Your Leisure 24 Hour Health & Fitness”.  “At Your Leisure 24 Hour Health & Fitness” only permits authorised personnel to access your information and information will only be disclosed to third parties where they have the appropriate authority.  We destroy personal information we no longer need, wherever possible.

31      ACKNOWLEDGEMENT, RELEASE AND ASSUMPTION OF RISK:

ACKNOWLEDGEMENT OF RISKS, INJURY AND OBLIGATIONS

As a member of “At Your Leisure 24 Hour Health & Fitness” you acknowledge that the activities you undertake have potential dangers and by participating in them, you are exposed to certain risks. You also acknowledge and understand that whilst participating in and such activities:

–              Staff are not on site 24 Hours a day, “At Your Leisure 24 Hour Health & Fitness” have staffed and non-staffed hours in which you can exercise;

–              Staffed hours may change, depending on workloads and personal circumstances;

–              The consumption of alcohol prior to and during the use of the facilities in “At Your Leisure 24 Hour Health & Fitness” increases the risk of causing injury to yourself, increases the risk of causing injury to others and possibly death;

–              The activities may cause physical or mental injury or possibly death;

–              Any physical conditions you may have, of which you may or may not be aware, of which you may or may not have disclosed to staff when becoming a member, may be aggressive or worsened by your participation;

–              Your personal property may be lost or damaged;

–              Other persons that are participating in such activities may cause injury to you or damage your property;

–              You may cause injury to others or damage their property;

–              The conditions in which activities are conducted may vary without warning;

–              You may be injured or your property may suffer damage as a result of the negligence or breach of contract of “At Your Leisure 24 Hour Health & Fitness” or other members;

–              We take all reasonable care to ensure the health and safety of all people using “At Your Leisure 24 Hour Health & Fitness” and you acknowledge that may be no adequate facilities for treatment or transport of you if you are injured;

–              You assume the risk and responsibility for and injury, illness and death, the loss or damage to property resulting from your participation in any activities

–              These Terms & Conditions form part of your Membership and are emailed to your nominated email address when you sign up. Unless notified otherwise, you agree and accept these Terms & Conditions after the initial 7 days cooling off period has expired.

32           TRANSFER OF LOCATION

As a current financial/ corporate member of “At Your Leisure 24 Hour Health & Fitness”, you acknowledge and agree that should “At Your Leisure 24 Hour Health & Fitness” relocate to another location within a 10km radius of its current location (that being 6/144 Maryland Drive, Maryland NSW 2287), that your membership will remain current and payable. If your minimum membership contract term has expired, you will have the option of cancelling your membership, with one months’ notice.

RELEASE AND INDEMNITY TO AT YOUR LEISURE 24 HOUR HEALTH AND FITNESS

In consideration of your payment of your Agreement (or your guest visit) you agree to release and indemnify “At Your Leisure 24 Hour Health & Fitness” as follows:

–        You participate in the activities at your sole risk and responsibility.

  • You release, indemnify and hold harmless “At Your Leisure 24 Hour Health & Fitness” from and against all and any claims which may be made by you or on behalf of you by other parties for or in respect of any incident arising out of any injury, loss, damage or death cause to me or my property whether by negligence, breach of contract in any way whatsoever.

–       You also agree that in the event that you are injured or your property is lost or damaged, you will bring no claim, legal or otherwise, against “At Your Leisure 24 Hour Health & Fitness”, in respect of that injury, loss or damage.
